What is Permanent Resident status? (Declaración de Inmigrado)


When an alien has taken Immigrant status (FM2) for a period of 5 years, he can acquire the status of "Permanent Resident".

For the above, within six months following the expiration of the fifth year of his FM2, he should elevate a petition to the immigration authorities proving that he has followed the provisions of the General Population Law and its regulations, and that his activities in the country have been honest and positive for the community.

An alien who manages to obtain Permanent Resident status, has acquired the right to reside permanently in México and as a result no longer has to renew or pay each years reauthorization and must only to report changes in his authorized activity, address, marital status and nationality, within thirty days of the change.

The declaration of Permanent Resident (Declaración de Inmigrado) can be requested before the Regional Delegation in Nuevo León of the National Immigration Institute, it is important to know that if the Permanent Resident Declaration is not requested within six months after the expiry of the last renewal of the FM2 or having requested it, it was denied; the authority will cancel the documentation, and the alien must leave the country within the period stipulated by the Ministry of Interior (Secretaria de Gobernacion). In these cases you can request new immigration status in accordance with the law

Finally, it is important to know that the immigrant with permanent residence can enter and leave the country freely, but if he should stay abroad for more than three consecutive years, he will lose his immigration status, just as if in a period of ten years is absent more than five. The ten year periods are counted from the date of the Permanent Resident status issuance.
